Builder just giving promises of possession bt giving reason of not having OC now we fed up so we are thinking to shift without OC bcoz we need house now possession date is 2018 they extend date Nov 2


A. Dear Sir,

If you do not shift without OC then it may be sold out to somebody else. It is not a punishable offence with imprisonment if you stay in the house without OC.

Who is selling the flat to you? Is it the builder or the first buyer? Depending on that you need to find out what all documents you need to have to be on the safer side.
In general you can ask for the following documents;
Sanctioned plan copy
All approvals like - water & sewage, Pollution, Electricity etc.
Mother deed of the land on which the flat is coming up
Sale Agreement draft copy
Joint Development Agreement ( if any)

You have to figure out from the DC/Tehsildar office that who actually is empowered to issue the NOC under the PTCL. Once you know this then you can rest assure on this topic. Generally the Asst. Commissioner holds seniority and more power then Tehsildar so, if the AC is issuing the NOC then it must hold good else he would not do so unless he is authorized to do so.
