A. Dear Client,

For the following situation, it is important to determine the pros and demerits of that registered sale deed as well as the papers of that partition suit. You may discuss the same with your attorney. Legal action cannot be proposed without a full examination of the aforementioned papers.

Thank you!

A. Hi, please note that all coparceners, including daughters, can seek partition and sale of the ancestral property. So your mother can sell her share of the ancestral property if she wants and she doesn't have to take anyone's permission for the same. If she has ownership of her share, she can sell it.

A. Hi,
You can file a suit for declaration in court for selling the unregistered land. If you get a court order, you can sell the whole 200 sqyards as you should have proper title upon the property which you want to transfer.

icon How to sell a flat in Kolkata

My father expired recently and my mother wants to sell off the flat in Kolkata, West Bengal as she is the co-owner. My and brother and I are ok with it. What is the right process to do this so that no

A. Dear Client,

Your father's property was descended upon your mother, you, and your brother, each having an undivided one-third part after his death without making and publishing a Will. In order to change three of your names in the Record of Rights in the place and stead of your deceased father, you'll need a Legal Heir Certificate. You and your brother can legally assist your mother in the Sale procedure by using a registered Gift Deed or a registered Power of Attorney in her name.

Thank you!

A. If the property was transferred by your grandfather to your father by registered Gift Deed and thereafter through another registered Gift Deed your father transferred that property to your mother, then your mother becomes the absolute Owner of that property. You have not specified whether your mother is alive or not and who is /are going to sell the property. Until and unless the relevant facts be specified, proper legal remedy cannot be suggested.

Can my elder brother claim my self acquired property(plot) which I purchased after my marriage with my own money? when partition of my father's property was happening then my brother brought a point

A. Dear Client,

As its sole owner, you have an exclusive right over your property, your ownership of the property remains constant. A brother can only claim the share in the ancestral property, as a coparcener and not over your self-acquired property.

Thank you!

A. Dear Client,

A father (current owner of the ancestral property) and his son have equal ownership rights over the property. The distribution of property should happen in such a way that each share gets further divided into successive generations. If an ancestral property is willed, to your sister it will become self-acquired property. If the ancestral property is divided into the owners of the property as per the share. Then the property will lose the title of ancestral property.

Thank you!
