False Income and Assets Affidavit

Sir,
My wife left my home after 15 years of marriage in April 2016, then she filed HMA Divorce Case in August 2016 with false facts in attached on oath income and assets affidavit which we challenge on wrong suggestion of my lawyer in Criminal court of ACMM in Sept. 2016. After that she withdrew the above HMA Divorce case with liberty to file proper petition after we challenge the affidavit of Income and Assets u/s 182 in ACMM Court.
Now in April 2018 we have to withdraw the case as by law its non maintainable in ACMM court with liberty to file in proper court.
1. Can we file the above case in Family court again which we withdrew from the ACMM Criminal court?
2. Does it matter that the HMA Divorce case has been already withdrew by the wife after we challenge the same in ACMM Court and she filed the fresh case with new facts and allegations in the new case and new on oath affidavit for income and assets as her lawyer always state that there should not be any action on the withdrawn petition.
