I had deposited a security of 2 months when i took the flat in april 2019 whose agreement ended on march 2020 then due to lockdown the owner of the flat and we, the tenants agreed with mutual concent that he will take 4000 rs less per month till lockdown ends. Now we are saying about the leaving the flat first he says that according to agreement he will not give the security deposit then we said that the agreement had ended then, now he is saying that he will now take the 4000 rs per month for 4 months and then after then he will refund the security.

A.I have gone through your query in detail.
1) Sorry to say but you have not given very clear picture as to what was the Security deposit you are given as a security deposit and what is the rent for every month... But as you said he will take Rs.4,000/- less till the lockdown ends but you are actual agreement has ended in March 2020...
2) As per your query it seems that you are not likely to get the refund of the security deposit . so better way instead of paying the rent every month tell him to deducted from the security deposit amount and once the security deposit amount it is almost over you may vacate the said premises... Otherwise getting the deposit refund from such kind of flat owner will be very difficult and become a Messy job.
3) At last you may be left with no option other than serving him a legal notice for refund of security deposit amount....
4) Better handle this matter tactfully and adjust your monthly rent in the security deposit amount by saying that currently you have no proper income or so..

A.It is mutual understanding. Then you may retain the keys and ask him to court to the keys.
