Declaration of title
A person had executed agreement to sale in 1967 with grandfather after few days he denied to execute sale deed and also filed suit against us on the ground of forcibly possession but court dismissed his suit with cost .and finding given that defendant have legal possession and didn't breach of contract.
Unfortunately, we didn't file suit for specific performance but we have possession till today(since 50 years). Now legal heirs of seller are threating us and saying that it is our land.
So what is legal remedy available to me and pls.also refer court judgment regarding such type of matter. Thank you!
A.Dear Sir,
Now you just file a suit for permanent injunction claiming adverse possession thus you will be allowed to stay in the land forever. Your title is declared by way of adverse possession since the LR’s have not taken any action till today even though Court dismissed their claim.
