i bought a house along with my brother 25 years ago. I had to change my name at work so all documents made after are with my new name including my children's document(with my new name) except the documents made before( Without name change process as i didn't knew about ). Now we want to sell the house but it still has my old name on its papers. Will that be a problem? What should i do?

A.No. It should not be a problem. You can file an affidavit stating that you changed your name post the purchase of the property in question and attach evidence in the form of IDs to prove the same. Will not be a property.

The same can be specifically mentioned in the sale deed to protect your legal interests.

A.I have gone through your query in detail. as you want to sell the house but it still has my old name on its papers

1) If the authorities are ready to accept the name change affidavit stating that one and the same person, then you can surely go ahead with it..
2) Incase if you would like to make it on official node then you will have to make the so-called “Gazette” which is valid all over India and the globe...
3) I am providing the Legal process for the NAME CHANGE- mistake for getting the official “Gazette” of Name Change.


DOCUMENTS REQUIRED FOR NAME CHANGE / GAZETTE

1) PHOTO : One Passport Size Photo
2) IDENTITY PROOF : Pan card or Passport or Driving Licence or Aadhar Card or Voters Card (ANY ONE)
3) ADDRESS PROOF : Ration Card or Aadhar Card or Electricity Bill (ANY ONE)
4) AGE PROOF : Birth Certificate, School/ College / TC leaving Certificate, (INCASE OF MINOR BONAFIDE CERTIFICATE with SCHOOL IDENTITY CARD)
5) AFFIDAVIT : ( If Any Made for any reasons like Numerology, Astrology, Marriage, Passport, Adoptions, Spelling Mistakes etc )
6) APPLICATION FORM : Duly Signed Application Form with OLD & NEW SIGNATURE other details like Old & New Name, NEW Correspondence address, Contact Details & reason for Name change
7) CASTE CERTIFICATE (IF ANY) : SC/ST/NT1,2,3
8) LEGAL DOCUMENTS (ANY ONE OR AS APPLICABLE) : Affidavit / Marriage Certificate/ Nikah- nama / Adoption Certificate/ Divorce papers/ Divorce Decree etc.
9) MOBILE NO. : For OTP
10) EMAIL ID : For LOGIN & GAZETTE COPY

A.Dear Sir
you can use both your names the old one and new one as XYZ @ ABC.
thus you can sell your property easily
