I have been staying in a rented house for 17 months now. The leave and license agreement is from 1-04-2019 to 31-03 20 (12 months).Due to lockdown we could not renew the agreement and hence I paid the rent till August.I want to vacate the house after August and the same had been communicated to the landlord earlier( not in writing )but the landlord and the agent have asked me to serve 1 month notice in writing and pay the rent for that one month.But since the agreement is expired am I liable to serve the notice and pay the rent? The following term and condition is mentioned in the agreement:
The lock in period on this agreement is 6 months, i.e either parties cannot terminate this agreement for the first 6 months, and there after either party may serve 1 month notice in writing, in advance to each other to vacate the said Flat for reason of their own.Please advise

A.1. You are required to pay one month's rent or notice period before vacating the premises,
2. the expired rent agreement is binding upon both the parties,

A.As the earlier agreement period expired on 31-03 2020 and there is no further renewal. So terms and conditions of earlier agreement has come to an end. So now NO need to serve the notice and pay the rent. Just pack all the stuff & load in truck & move On .. No one can stop you Legally

A.Dear Client

As your earlier agreement period expired and there is no further renewal. So terms and conditions of earlier agreement is not binding on you. You can resolve your issue with mutual discussion else in case of any compelling from owner side you can take recourse of consumer forum/ help of police .

You have to issued legal notice under section 106 of transfer of property act and paid the rent irrespective of expiry of rental agreement .
