Currently i am living in ground floor of a 2400sqft plot with my family. We have decided to build first floor of our house. Our plan is we have left 10 feet margin from front. 6 feet margin from one side and 6 feet from rear margin. Now, our neighbor, at the other side, have same 24000sqft plot. He has built area of almost 2300sqft at each floor with ground + 2 floors. He is claiming and forcing us to leave 5 to 8 feet margin from his side. Since, he has his doors and windows facing our side and claiming our construction is illegal as it will block sunlight and air coming in his house from our plot. As other side of his plot he has covered it with aluminium section and left with no scope of sunlight or air. He is arguing with us and threatening us to go to court.

It is important to know the building plan before determining if the construction is illegal or not, please settle the matter amicably with your neighbour or you can consult a lawyer for the same.
There is no law which prescribes leaving margin of 5 to 8 feet margin. Ask him to approach the court if he has any provision of law in his favor. Just start construction and if necessary get injunction order from court if they obstruct.

On your plot you have every right to construct as per your own wish .
If your construction is as per approved building plan from development authority then nothing to worry.
If you want to construction without plan approval then you need to be little bit worry if your neighbour complaints as development authorities may notice you to first take plan approval.
However there are many way out to overcome from these complicacies in different tactical way can be discussed over phone.
Pls. Note if your neighbour also has constructed building deviating plan approval or without approval then you also have right to complain against such illegal construction and demand for action. So advice him to mutually resolve issues.
You can make police complain also for threatening you for his wrongful gain and compelling to fulfil his demand , illegally resisting you to act as per your will.
