I had send the RTI Application to the First Appellate Authority regards with some issues related with the Public, but the message which i had been received from the department is that cannot replied the application due to the FAA is unavailable at the office. Then is there any options which can be available as a Second FAA.

A.Yes, you can made appeal against it. As per RTI Act, such reply of department can be challenged.

A.This is a travesty of justice because your appeal has not been adjudicated only. Without any discussion on the actual application it has been left in the lurch. Write to the CIC that appellate authority is not present only, and information is urgent. The quickest way to do it would be to approach the HC in writ, but you should still write to the CIC first as that is your alternative remedy, which you should ideally exercise before going to HC.

This clearly cannot be a reason for dismissal or non entertainment of Appeal. Although there is provision of second appeal, but since your case has not been heard, it cannot be termed as proper dismissal for you to approach in second appeal. Write to CIC and then move HC.

A.It is department responsbility if FAA not available hearing authority must be delegated to another competent authority.
If your first appeal application is not entertain because FAA is not available you can approach 2nd appellate authority State Information Commission

A.RTI application is not sent directly to the First Appellate Authority. It must be appeal which you would have sent. However, if FAA is not available or any reason whatsoever you can approach superior appellate authority which is established there by statute.
