I own 2 residential flats jointly with my daughter in Bangalore. After marriage my son-in - law involved in rental managing. Even though initially I left it, slowly my daughter stopped responding to my queries. Now they Have shifted to Canada. Now after consistent pressure I got possession after he ensured vacation of flats. I stay in Chennai and find it difficult to manage vacant flats. My daughter has stopped communicating with me. The flats were actually bought by me and willingly registered by me as a joint property. Can I now seek independent legal control of the flats, since I do not want to deal with my son-in-law?

A.Dear Sir,
You just take possession of the property and then ask your daughter to execute relinquishment deed in your favour in respect of her 50% of share saying that it is your absolute property.

A.Hi,
Since it is a joint property between you and your daughter, you both are co-owners hence she will also have a say in the decisions relating to the property. If you want your son-in-law totally out of decision making process and want total control then you can ask your daughter to relinquish her right over the property either for consideration or without consideration and post this finalise it with a relinquishment deed.

A.Hi,

A.Your transaction is illegal by Benami Transaction Act so you cannot claim independent right. You can claim your portion and can also claim partition.

A.since the sale deed contains the name of your daughter as a joint owner, resultantly, you cannot claim a complete ownership,

A.Since flat is registered jointly in name of you and your daughter. In such case, your daughter is also a owner in said flats. If you want independent legal control, than your daughter have to relinquish her share in your name.
