Divorce

My brother got married and took his spose to settle in Japan. After 7 days the wife forced him andncame back to paternal home. My brother returned back to Japan and tgen the wife fiked 498 a and domestic violence against hin falsely. Its been 3 years now the cases being fiked. How can this be resolved and if he returns will he not be able to go back to Japan?

1. Check the status of the case in court. Whether any NBW issued by the court?.

2. As long as your brother co-operating with investigation agencies there should not be any problem in flying back japan.

3. You can approach high court to quash the FIR, if no charge sheet filed.

What are the contents of the FIR ? and what other sections are there in the FIR ? Consult a lawyer and move to High Court accordingly

At first take bail and then your brother can file a quash petition before the Hon'ble High Court under section 482 of the Cr. P. C for quash the criminal proceeding. And without detail discussion proper consult is not possible.

Your brother may get anticipatory bail from concerned district court. If he is unable to come we have also solution for this and definitely he will get anticipatory bail from court. Fix an appointment with us through vidhikarya and we get you out of this trouble.
