I am in a relationship with a guy for almost 4 years now, he clearly doesn't want to live with his wife and wants a mutual divorce. But the wife is in no mood to give a mutual divorce and tortures him every single day. How do we go about it? He has a child and is ready to pay for his needs. Should he see a lawyer for more clarification?

A.1. Ask him to file divorce on the grounds of torture.

2. The proper opinion can be only given after one to one interaction. Tell him to meet a lawyer to find any possibilities.

A.A. If wife is not ready to give divorce mutually than the question of divorce by mutual consent does not arise. Yes if he wants to get rid off his wife than he has to file a case for divorve against hos wife stating therein the grounds on which he wants sepration from his wife. And yes if husband goes to file a case for divorce than it may accelerate the chances of filing cases from her wife also. She may file cases like DV Act and 498A IPC etc.
