Tenant not vacating

My father has a flat in Ahmedabad where a tenant is staying. Even after repeated requests, they are not vacating the flat. I need flat back as i need to sell it. Now there is some dispute between society members and my tenant, and they both have approached police with complaint against each other. Now police is asking me to ask my tenant to vacate the apartment or we would be in police trouble.
Since it was just verbal agreement, we don't have rental agreement as well as police verification done of tenant. I need help in resolving this .what's the best way to get flat vacated without any legal trouble

The tenant is required to be served due notice under law, the length of this notice period will depend upon the terms of the tenancy agreement. If there is no written agreement, 30 days' notice should suffice. You can file an eviction petition in Court and have an order passed that the tenants be removed after the notice period is completed. You can also ask the police to remove the tenants themselves, once the notice period is completed.

As per your inputs you have every right to evict your tenant, first issue a legal notice to him stating all the reasons then file a eviction petition in court
