A party alleging fraud must prove by clear and convincing evidence(1) a false representation, (2) of a present, material fact, (3) made intentionally and knowingly, (4) with intent to mislead, (5) reasonable reliance by the party misled, and (6) resulting damage to him.

A.Hi,
The first step to initiate a suit is to file a plaint. A plaint is a written complaint or allegation. The party who files it is known as “plaintiff” and the party against whom it is filed is known as “Defendant”. File requisite amount of procedure - fee in the court. File 2 copies of plaint for each defendant in the court.

You can initiate a legal actions against the person who committed fraud by filing a complaint in the police station with all valid documents. As it is a mail fraud you better approach Cyber Police to process the same
