Hello sir.,
I am from Karnataka, we have land dispute with neighbouring person, 2 years back we conducted survey of our land and through that we come to know that 23 gunta (0.5 acres) of our land is acquired by him, after survey he opposed to give us and he took time for re conducting survey...
He regestered complaint in police station and psi ordered him to take survey within one month but he delayed for 8 months due to crop in land. But now he claiming that he want that soil in that bund and trees too... so please give me suggestions... 1.what can we do now to take back my land
2. Now is that bund belongs to him or us...
3. If suppose he refuse to give us land, what are the ways we have to take back our land through court.

A.Dear Sir,
You have to file possession suit after getting survey records which must clearly show area of encroachment committed by your neighbor.

A.Hi,
1. File a petition for eviction or ejectment to have him removed from the property. If he refuses, you can approach the police with the Court order and have them use physical force if necessary.
2. The bund and the adjoining half acre still belong to you, your neighbour has encroached it, as you have discovered from the survey.
3. You can file a suit for declaration of title, the Court will then declare that you are the lawful owner of the land.

A.Hi,
1. The bund belongs to you, he has not met the requirements of adverse possession. Approach the Court with all relevant documents to prove your ownership of the land. You can file an eviction or ejectment petition to have him removed from the land.
2. You can file a suit in Court for declaration of title.
