Oct 28 th met accident 4 wheeler hits two wheeler and two bikers injured.Though no mistake by 4 wheeler, FIR filed on 4 wheeler IPC 279,337.
Details:
4 wheeler own board
Acting driver
Car purchased as 2nd hand by jun 2020,
RC book name transferred.
Insurance was still with previous owner name.but, validity till Jan 2021.
During covid situation, couldn't do the insurance name transfer on time.
Question is, third party can be claimed by bikers?. Insurance company liable still?
4 wheeler punishable by penalty or any claim to be worried? Please advise

A.Hi,
The insurance will not be valid if it is still in the previous owner's name. The burden of proof will be on the four wheeler's driver to prove his innocence.

A.Hi,
This would depend on the terms of the insurance policy. However, the insurance will not be valid if it is still in the previous owner's name.
Innocence will have to be proved by the person driving the four wheeler.
