Hi,

I am working in Dubai/UAE, and the driver of our car has made an accident.
The person involved in the accident has had a fracture and has put a court case claiming 10 lack rupees as compensation.
Since I am the owner of the vehicle, the court Notice is sent to me on my name and my address.

But since last 6 months I am working and residing in Dubai, UAE, and now do not know how to respond to this legal
notice to appear in court in Bangalore. What is the procedure for such a case, where in the Owner of the vehicle is out of the country,
but the legal notice is sent to the owner.

A police case is filed and an FIR has been written. The FIR has the name of the Driver, his driving license and all the details of the accident.
Do I need to provide any Affidavit from UAE in this regard tot he court, or should we hire a lawyer to represent me in the court as
I am not residing in India. Can my parents be present for this case on be behalf, and if so for this should there be an affidavit.

please advise.

A.Hai,
Whether it’s a case of negligent driving or a case of drunken driving, the onus is on the person driving. The car owner can be liable if the car was not in a roadworthy condition. Please consult a lawyer for further proceedings. If you find this helpful, please rate us.
