My father has married twice. A daughter and son from first wife and a son from second wife. Now he has gift deed some part of his ancestral property to his second wife'son.
I am first wife's son..I want to ask what can I do now..can I file a case on him to get my ancestral property back.

A.Hi,
You can file a suit for partition of the property. As legal heirs of your father, your sister, your stepbrother and you are all entitled to equal shares of any ancestral property. His gift deed is thus not valid and can be challenged in Court.

A.Hi,
Ancestral property cannot be gifted without the consent of all legal heirs. As such, you can file a suit for partition of the property, you are entitled to the same share as your other siblings.
