Hi Sirs/Madams, My neighbor has a mango tree near(2 feet gap) my compound wall. This tree is dropping so much wastage (leaves/other stuff) in our compound. And due to the roots, it also broke my wall slightly.

We gave a complaint to the panchayat officer on this, after this neighbor has started another story that we have occupied their land near the compound wall. As it is a village and govt given lands around Y.2000, no one has any registration papers. The outsiders who have come to resolve the tree issue are also supporting that argument, but that is without any proof. Moreover, we have built our compound wall 17 years ago. Till now there is no complaints registered by neighbor regarding the land. But, when I gave a complaint to panchayat about the tree, he raised this argument.

Please suggest, how can I force them remove the tree or atleast its branches which crossed the border. And with land argument how to proceed?

Can we complain about the tree nuisance in police station, and does easements act and doctorine of adverse possession help me(lands are unregistred - govt given lands)?

A.Removal of the mango tree is an expensive process as you will have to pay heavy compensation to the owner which may go in lakhs instead resolve the issue amicably.
