Fasle accusations of abduction and rape

Sir,
We live in army quarters (meerut cantt), my father was falsely accused in a rape case by the daughter of our former maid (soni-16 years), seeing her daughter's behavior my mother asked them to vacant the servant quarter, no other officer's family agreed to provide them servant quarter in our colony because of her daughter's spoiled character and stealing habits. Post 3 months leaving our colony, soni left her home and next day was found by the gaziabad police, she accused my father of abducting her and taking her to moradabad to ghaziabad in his car, and also have been raping her once in a while for past one year while she lived at our servant quarter. Although the police removed the section of kidnapping after investigation because my father was found to be at our native place lohaghat, uttrakhand from 24 Feb 18 to 3 March 18. My father is an Ex Servicemen, 54 years old and has a history of neural problems, we have his more than 2 years old medical papers suggeting his less intereste in pleasurable activities due to the same neural problems. We have applied for bail in high court now . I need a legal advice in matter , kindly help

But as you have described the facts i think Honble High court would surely grant bail to your father.

Sir her medical examination suggested that there were no traces of force used and the girl was habitual of sexual activities. There is no proper document to prove her age , they only have 5th class marksheet, so we can also challenge the age, and no one's name was given in the FIR by her parents, they themselve contacted us and wanted to close the case and gave us affidavits, but later they created a big drama in front of the police and media because my father was not arrested, and after 3 months of FIR, parents stated that they saw my father with there daughter once and tried to make him stop but he didn't . There story has a lot of loop holes but the matter is about bail for us . We have seen in trial court that the judge ignored all the facts and only focused on the allegations and the age of the girl.

You have to find out the most possible way to explain to the court that your father hasn't committed Rape. Because she is sixteen and minor, the case more stronger than it looks like.
