Hello,
I married my girlfriend after 7 years of relationship. Now its been 3 months of our marriage but my wife is misbehaving a lot and tried to suicide in front of us once. She mistreat me and my parents . Now its been one month that she went to her parental house after a querrel between her father and my family. After going there she talk a lot of bullshit about me and my parents and sister on chat. She is not pregenent.
I know I can file for divorce after 1 year of marriage. But I want to know if she won’t agree for MCD then how long the contested divorce case would run? How much maintenance I would need to give if I earn around 80K. How much alimony I need to give if I have no property and not much bank balance. Does the bank balance and property of my father matter in this case to decide alimony if I am the only son of my parents (Have one married sister). Please help how can I get rid of her asap if she doesn’t agree for MCD. Thanks

First of all give a written complaint to the nearest police station of your area and write all the facts one by one and take the DDR no of your complaint this will help you in future. Secondly file a suit for restitution of conjugal rights which will show your intention that you want to take bak your wife despite of the cruelties she done on you . Since only 3 months have gone so you have to wait for 9 moths for filing divorce. Till then the case of restitution of conjugal rights will be decided either in ur favor on the condition that you fight it seriously. And that decree will help you to take divorce if she still refuses to come back . As far as the point on the maintenance is concerned it depends on many factors like is she is earning lady or not. Save all screeshots of the chat and preserve your chat on email for future use. Dont panic stay calm. Law are made for helping the aggrieved ones not to feed the greedy ones. All the best. Relax, there are options where you can ask your wife to stay away from you, till one year you just need to pay her the maintenance. And don't worry till one year even she cannot file for divorce ...which means whatever maintenance you will decide for her SHE WILL HAVE TO ACCEPT IT ,.....and after the completion of one year you can file for divorce which may take somewhere around 6 months.
but be prepared for the other charges which may she can file against you such as "Dowry" (even if you have not accepted it) or other kind of allegations.
