Delayed request of pending dues ( 4 years later)

Society has asked me for delayed maintenance charges after 4 years. All those years there is no communication from society. Now they state that it my responsibility and not society to clear account. They did not inform me anything all those 4 years. I was present in all AGMs.

A.Hi,
If a flat owner does not pay his maintenance on time, society will take legal action to recover the debt. If you have not paid maintenance, you would be required to do so because it is a legal requirement. However, if there is a mistake in the maintenance records, such as if you paid but the society did not keep track of it, you have legal recourse.

A.Hi,
If a flat-owner fails to pay his maintenance on time, the society can initiate legal proceedings to recover the bill amounts. In such an application, the society will request the Registrar to issue a certificate for recovery of the amount against the defaulting member. If you did not pay maintenance then you will have to pay it since it is to be paid compulsory. However, if there is any error in maintenance records, like you have paid but the society did not maintain the same in their records then you have a legal remedy.
