मेर पिता जी की दादी अपने माता जी की इकलौती संतान थी जिन्हों ने पैतृक संपत्ति मेरे दादा जी के बड़े भाई को गिफ्ट डीड बनाई उस समय मेरे दादा जी का जन्म भी नही हुआ था और बड़े दादा जी भी 6 महीने के थे उस गिफ्ट डिड मेरे दादा जी की माता का नाम भी शामिल है मेरे दादा जी और मेरे बड़े दादा जी के बीच सम्पति का बटवारा 1980 के दसक में आधा आधा हो गया था सब की सहमति से ,लेकिन मेरे बड़े दादा जी के मरने के बाद 2002 में उनके बेटो द्वारा आपत्ति दर्ज कराई गई और मेरे बड़े दादा जी के बेटे कहने लगे ये सिर्फ मेरे पिता जी के नाम मे है इसमें आपका कुछ नही जब कि सारे प्रोपर्टी का मोटेशन मेरे दादा जी के नाम और मेरे बड़े दादा जी के नाम आधा आधा हो चुका बटवारे के 5 साल के अंदर में अब सर इस बात को लेके मेरे बड़े दादा जी के बेटो के द्वार व्यहार न्यायालय में टाइटल सूट दायर किया गया है ,इस आप कानून विद्वानों का मार्गदर्शन चाहिए सर्

Since the mutation has been done in grandfather's name already, that part of the property cannot be claimed by anyone else in through the title suit. You will have to give the entire details of the property to the court with supporting documents, so that the title suit can be dismissed.

The property has already been divided equally between your grandfather and his elder brother. The mutation has been done in your grandfather's name already. So, the part of the property for which the mutation has been done in your grandfather's name will belong to his legal heirs, the son of your grandfather's elder son cannot claim that part of property in the title suit.

Ancestral property devolves on all the legal heirs and it cannot be gifted away by single sharer.

बाकी सब डिपेंड करता है कि कौन-कौन से पेपर आप कोर्ट में जमा करते हैं?
