I booked my bike on 02 March 2021 with Royal Enfield Bandra. The price that came on the receipt was 2,32,000. The delivery date of the bike was 30th June 2021. Now the price has been hiked by govt. from July 1st week and company has delayed the deliver and said the price has been increased by 14,000. They also said this is how automobile industry work and The same point has been written in the recepit. They are not giving refund as well for cancelling the booking. The point i mentioned was since they have delayed giving the bike so the price was increased, its not my fault so why would i bare the addittional cost. Is there any leagel way to encounter this?

A.Dear Sir,
Since it was clearly mentioned in the receipt so you cannot agitate above point now. You have no merit in your case. Just take the delivery of the vehicle and thus put the matter at rest.

A.if the delay was on the part of the company then definitely a case lies against the company but to be more accurate with any conclusion of this kind it is better to first do a double check on the terms and condition under which the bike was booked and if the condition stipulates that price increase in the meantime has to be borne by the customer then the case may be difficult to win if the price increase has been independent of the delay. In any case you can always exercise your right of refund in case the default is in their part and you are prejudiced because of that. I would like to volunteer in this case as I find the matter interesting in case you feel comfortable enough to engage me. this is by no means be construed a solicitation but only an offer of help.

A.You can file a consumers case in this respect but for Rs 14,000/- will you be willing to do that is the question because you will require to pay lawyer for the same and if you want to appear in person than also it would take time and effort on your behalf for Rs 14,000/-. You may think about this. At the most you can issue them a legal notice and try if any communication you can receive on their end which is upto you but even there you incur an expense towards lawyer though less and nominal but you incur. Thank you.

Generally at the time of booking a vehicle the dealer provide the customer with the information that the price of vehicle would be of that day of taking the delivery and mention the same in the booking papers and also provide you with a delivery date. If the dealer fails to deliver you the vehicle on the said date and you have to pay the dealer more amount because of hike in price then you can surely approach the court and file a suit against the dealer and claim compensation for the same. I would you suggest you to first file a complaint against the dealer in the consumer court and seek relief there. Then move to the civil court.

You have all right to go the court for such actions of the automobile dealer. You first approach the consumer court and file a complaint in the consumer forum of your place. You have all rights to claim back your refund.
