Deceased daughter children's when can't claim ancestral property of the mother

Advocate Sinjari Bandyopadhyaya

Responded 2 years ago

A.Mother's ancestral property cannot be considered as ancestral in the hands of children so mother's share in her ancestral property will be considered as self acquired and the mother is entitled to transfer the same in registered manner to any person of her choice and her deceased daughter's children cannot raise any objection.

A.Hi,
The children have right on the property of their mother. Under Hindu Law, the property of a mother devolves as per the Hindu Succession Act, 1956. The Act applies to intestate succession.
