Our Lease got lapsed in Feb'21, but we wanted to shift the house in May so after consulting house owner we didn't renew and with mutal agreement we continued to stay without renewing the lease agreement, because of covid we couldn't shift on time and now we want to shift, however owner wants to charge me rent from March till date of Rs,20,000 P.M and he wants to deduct that amount in the lease amount, this is unfair as we didn't agree to this , Please assist

A.Dear Sir,
You have not mentioned how much amount you have paid as lease amount. If lease amount do not carry any interest then he is not suppose to collect rents from you. It goes without seeing that it was automatically deemed renewed and you need not vacate the house until he pays your entire lease amount.

A.Dear Client,
If your house owner had agreed without renewing lease paper, and there has been Corona pandemic , so the owner can not charge increased or renewed rent as per lease deed. Moreover he had assented and continued with earlier lease. Hence, he can not deny that be had not allowed to continue, such unfair increased rent can be challenged in the court of law or by legal notice for mental harassment and threatening of filing of fabricated case against you. The terms and conditions mentioned in the lease deed have to be followed here and the landlord can't demand increased rent at his sweet will.

A.Hi,
It is totally unfair. The terms and conditions mentioned in the lease deed have to be followed here and the landlord can't increase the rent at will. You can choose not to pay the said amount and can move legally.
