Token money refund for rental

We had paid a token sum of 10000/- to owner account directly. At the time of the deal we were told by broker the rental would be 25k+ 2500 maintenance as the tower is not operational and would only allow shifting from 1st Oct. Later on discussion with owner we were informed that the maintenance is 5000/- to which we had informed broker to seek clarity and get back to us. The agreement on any form of paper work has not been executed until now. Since the monthly rental would be high and the owner is not ready to reduce the amount we decided to cancel the deal. The owner is now refusing to refund the token amount of 10000/- saying it is non refundable. The broker is absconding and the owner is not budging to our request. What is the rule on advance token refund and how can I get my money back. Pls suggest
A.Dear Sir,
You may get issue a legal notice and get back your amount and better you approach Police and require such amount.

As the agreement is not executed, the terms can be changed now as per the decisions of the parties. It is important to know whether the Rs. 10,000 was initially agreed to be refundable or not. File a case now to claim back the money and to track the absconding broker.
