Wealth Test for OBC reservations
I am going to appear for the Civil Services Exam 2022 as an OBC-NCL candidate. As per 1993 OM of DoPT, the Income/Wealth test criteria states that parents must not possess wealth above the exemption limit as per Wealth Tax Act for 3 consecutive years to qualify for OBC non-creamy layer. My questions- 1) The exemption limit under Wealth Tax Act is just 30 lakhs which has not been revised since 2010. Also, Wealth Tax was itself abolished in 2015. How is the wealth test actually applied when this limit is clearly outdated? 2) Since the wealth test is applicable to all OBC candidates and considering that all forms of wealth including house/property in urban areas, motor vehicles, jewellery etc are covered under Wealth Tax Act, how is it that no candidate is disqualified on the basis of Wealth test?
A.Dear Sir,
No such tests would be conducted individually but what is declared by your parents will be taken into consideration unless somebody lodged complaint.
As the wealth tax system itself was abolished in the year 2016, it should not be applied for the calculation of the OBC non-creamy layer. Candidates may use any other immoral or illegal means to avoid the liability of wealth tax or may fall under the exceptions of assets in the wealth tax in order to not be disqualified.
Thank you
