Two people sold 200 sq meters of land 100 sq meter each by a single sale deed in favour of Mr. X though one of them was not owning any land in his name. Mutation was done in the favour of Mr. X of 200 sq meter land. Mr. X sold 100 sq meter of land to Mr. Y. What is the legality of sale of 100 sq meter of land by Mr. X to Mr. Y ?

A.The entire transaction is void.all the persons selling the property should have a valid tittle in order to sell it.

One of them was holding a valid title. Why that part of instrument is not executable.

One of them was holding a valid title and in sale deed it is separately mentioned that he is selling 100 sq meter of land out of specified land number then why should not that part of sale deed is not valid? Just because two different agreement executed through a single sale deed will make both of them null and void?

Yes both will become null and void because a transaction cannot be partly valid and partly invalid.

A.Since persons selling the land is not the absolute owner hence title will not pass to the buyer.
