Hello sir...I am expecting a false 498a case against me from my wyf.i m a govt servant.i want to know if she files such case and if I want to take regular bail...how would I take it ? Can the same magistrate give me bail also right away? Or I will hv to go to high court for the bail? I don't want to take anticipatory bail.

A.Since bail has been explained her I would only like to add that normal practice in Indian courts is that your anticipatory bail petition will be heard only on you filing a certified copy of FIR before the Court , which means your petition will not be entertained just on your apprehension or anticipation of arrest.

A.Regular Bail is applied for by a person after he is arrested by the police on the basis of an FIR. while Anticipatory Bail is granted before a person is arrested, in the apprehension that he might get arrested in future for a certain criminal offense. There is another kind of bail which is the Interim Bail. This is like a temporary bail which may be granted till the time the application for Anticipatory Bail or Regular Bail is pending before a Court. Interim bail can be extended by filing an application. However, if the period of interim bail is over and the accused does not pray before the Court for extension of interim bail, the court can cancel the interim bail and the accused is taken back into custody.
