Hello Respected Lawyers,
I think i have some tricky case here.
My grand father(A) purchased 90 SQYD of land, 30 years ago. He divided those 90 in to 3 parts A,B and C for his brothers with mutual understanding. they were all possessed with their piece, both were constructed and enjoying it accordingly.
A has single registration and cleared title. But all the three parties has join registration on B and C. Now A wants to purchase B land with mutual understanding and B also ready to sell, but C is making disturbances and he is not ready sign for registration.
Is there any way to register without signature of C?
We are not ready to file a case in court, because it takes lot of time to resolve.
or
Is there any another way to get legal rights on B's land?
I want to go for Home loan.

If a property is in the name of a person then invariably that person's consent is required to alienate ( sell/transfer) the property and it is mandatory requirement. Without his consent it will be difficult to proceed ahead. What you can do is get the partition done for the land and then proceed with the selling.
