One time maintenance - double payment issue

I have paid one time maintenance to builder in 2019 & now builder is declared as bankrupt, he is having financial crisis.. so project is still under process, we have got possession by 2018 only.. now society committee is asking to pay one time maintenance to society once again because builder is in fault now.. is this legal? can society asks to repay one time maintenance again? just because builder has not paid our maintenance account to society? kindly advise

You need to understand here that the society is not at fault but the builder is and when you all start living the society then you need funds to run the maintenance of the society and hence you all should pay. Whatever you have paid to the builder you can file a case against him to seek your money back but logically speaking the society has not received any money from you.
