Car Parking Issue at Apartment
My building has got Municipality permission for 20 Flats (5 Floors x 4 Flats each floor), but CAR parking has sanction by Municipality authorities for 14 Parkings only. But builder has de-marked for 20 Car Parkings. Some CAR parking were very congested, unable to open car door after parking. How we can proceed further on this.
A.Dear Client,
In a situation where the municipality has granted permission for a specific number of car parkings, and the builder has allocated more spaces than sanctioned, you may need to take certain steps. Firstly, document the issue with photographs and gather evidence of the municipality's approved plans specifying the allocated parking spaces. Engage with the builder, presenting your concerns about the congestion and the deviation from the approved plan. Request the builder to rectify the situation by either reorganizing the parking spaces or seeking additional approvals for the extra spaces. If the builder is unresponsive or if the issue persists, consider filing a complaint with the local municipal authorities outlining the discrepancy and the impact it has on residents. You may also consult with a legal professional to explore potential legal remedies or advice on how to address the matter effectively. Communication and documentation will be key in resolving this issue and ensuring that the parking situation aligns with the municipality's approved plans.
Thankyou

A.Dear client,
Since the have has violated the permit sanctioned by the Municipality, you can make a complaint before the municipality and if you were promised parking at the time of booking then you can file a complaint before the consumer forum.

A.Dear Client
What the builder has done can be called as deficiency of services and for that you can file a case in consumer forum and seek relief plus compensation from the builder. The builder might also be penalized by the Municipality for breaching the permission.
