Hi,
My divorce case is under process. My wife has filed interim maintenance by highly overstating my income. My case is if I don't attend dates, will the court Grant her the interim maintenance as per her wish ? Thanks

A.If you don't attend either in person or through legal representative, and raise your objection against the maintainability of her maintenance application, the court will hear and pass an ex parte order of interim maintenance. Where an ex parte order is passed by the court, you can make an application to set aside such order. The court after hearing both parties, will either set aside the interim maintenance order and allow enter your defence and contest the main application or simply dismiss your set-aside application. That is the worst scenario to happen where you've to go to the upper court for relief which is added expense.

Better enter your defence and raise your objections against her application for maintenance. To know whether your wife is entitled to maintenance, you need t share some facts about your wife such as living standard, her educational background, any job, if yes, her salary, your salary etc.

A.Dear Sir,

If your advocate is not able to convince the court with suitable documents then court will accept the material produced by your wife and it may pass directions against you to pay huge interim maintenance.

A.Hello
You may appear or not, court can grant maintenance to your wife. If you will not attend court date then court exparte decide the matter and issue warrant against you.

A.Answerd by Adv kavery Anand Bangalore.. sir if Ur wife is well educated and good earnings.. then prove it in the court... In maintenance case... If u can prove it .. she is well educated and good earnings... Then No court will entitle her .. single penny of maintenance..or alimony.

A.the sec 24 of the Hindu Marriages Act provides for interim maintenance, if you are not attending the court regular basis then court will order the interim maintenance. you have to contest the case.
