My father bought two wheeler for my relative.After several calls he is not transferring vehicle to his name still RC is registered to my father name.My father was dead on 1 May 2021.I just wanted to know if any illegal activity is happened from this vehicle, who will be responsible for that .What is solutions for this.
Note: The vehicle is 15 years old.
Please suggest me

After the death of your father, registration of the vehicle will be transferred to whoever possesses it. Hence, any kind of illegal activities happens after the death, then the consequences will be beared by the succession of the property.

Whenever there is an accident involving a vehicle the owner is called to the court along with the driver. Since your father is no more hence there is no problem for him and if there is any illegality involved with the bike then whosoever does the wrong will be liable.

A.If the bike is insured then the insurance company shall bear the complete financial liability otherwise the legal heir or successor of the deceased owner have to bear all the financial liability to the victim. It is necessary for you to ask your relative to transfer the name of ownership at earliest and kindly intimate all the information to your local police station, commissioner of police, RTO office where the bike is registered, regarding the time period in respect of the use of the bike by your relative and not your deceased father and also the date of death of your father and also attach with the said intimation letter all the relevant documents which may help you in future. You can take the help of an advocate for properly furnishing the information to the respective authorities. You need to inform all the competent authorities at earliest otherwise you may have to suffer a lot.
