Hiding facts - judge consider the Original Affidavit
1 year ago
Hello Expert
1. When the case is fought does the judge consider the Original Affidavit or additional affidavit also?
2. If the plaintiff has suppressed property owned facts and the defendant disclosed in court with proof. After years the plaintiff sold property. Will it be considered as Suppression of Facts? please share a case reference if any
A.Dear Sir,
Judge is at liberty to consider relevant material from either of the Affidavits or both of the Affidavits. However, if material facts are not disclosed suit of the Plaintiff may be dismissed but no action will be initiated against such Plaintiff.
