Change of child's Custody in mutual consent during cooling period
1 year ago
We have filed for mutual consent divorce and cooling period is in progress. Child's custody was given to father. However, now, I want to claim the custody of child as father is not providing any detail of welfare of child. Can i file for child's custody during cooling period without affecting divorce? Will I have to cancel first the mutual consent divorce and then can file for child's custody? Also, if later divorce is filed by husband, will it be filed in his city (UP) or where we last lived as rent agreement is on his name (Delhi).
A.Kindly file a separate petition and also please mention your religion, as the laws so governing will decide the procedure and further proceedings.
