If you have to make changes in the settlement deed due to mistake in the deed, and one of the party is not traceable, can the other party make a self declaration (the party to whom the property was settled and now wants to sell it, but the prospective buyer, saw that there was a mistake in the door number of the property ( a flat). So his lawyere suggested if the intial parties to settlement is untraceable, the other party can make a self declaration and get the rectification registerd. However, will this seld-declaration pose a problem to prospective buyer in the future

A.Dear Client, in such a situation, feel free to file a suit for declaration and then subsequent changes will be made thereon. Hope this helps!

A.Dear Client
If the other party is not traceable then you should not make a self declaration as that might be questioned by any prospective buyer. The safer way would be to file a suit for declaration and then on that basis that is the court order make the changes
