Share in father's property
My Father died years ago and mother is alive. We are 5 sisters and one elder brother in family. I as a daughter want to claim share in ancestoral property of my father, but my brother is not agreeing to that. How can I get the property documents for further details of land and claim my share in property. Please give me a clear picture of the procedure that I can initiate now and get it done.
Thanks
A.Dear Client
it is very clear that from the year 2005 even the daughters have the right in the ancestral property and hence you have the legal right. Now to execute that legal right what you have to do is to send a legal notice to all the other legal heirs following which if they partition the property as per the partition deed then its all fine else you can file a partition suit in the civil court.

A.Respected ma'am,
Please know that your brother has no right to deny you the access to ancestral property. It is your birthright after the amendment of 2005.
Do understand that the property will be divided in seven parts for each sibling and the wife. You are entitled to 1/7 and your brother is also entitled to only 1/7. Any transaction of the property without your consent will be invalid.
