We have a flat in Mumbai. The flat is in the name of two brothers. Brother 'A' has already paid half amount of the flat in cash many years back but doesn't have any proof. Brother 'A' has also been paying maintenance, electricity, Property Tax etc.But as Brother 'A' doesn't have any proof of the 50% paid for the property, Brother 'B' is demanding his share.Is there any way to get the property in the name of Brother 'A'.Thank you.

A.Dear Sir,
Brother A can claim adverse possession over the property on the basis of documents like continuous payment of maintenance and electricity bills.

A.Dear client,
No, without proof brother 'A' cannot claim to be the absolute owner of such property when it is already being shared by another person.

A.Dear Sir,

You have to approach Civil Court seeking a decree as proposed and during the trial you have to bring some witnesses who are ready to give evidence in your favor.

A.If the said property is registered in the name of two brothers jointly then automatically by virtue of law, both the brothers are jointly equal share owners of that property so he need not show any proof of paying the money for the said flat as it is already registered in favour of both of their names...

If the property is registered in the names of both the brothers then there is no way that brother A can get he complete ownership without the willingness of the other brother B
