Mutation can not be done as the registration of the shop done and the deed is between the developer (who is also the land owner) and the buyer?what can be done?

A.Dear Mr. Bhowmik,
you are buying a shop means you are buying it over a piece of land.
Since land is involved you have the right to ask for mutation.
Once mutation is done you are permanent owner of the land as well as shop.
If the developer says No, then first send a Legal Notice followed by a Court Case.

Dear sir,
Thanks for your quick response.
I got the shop registered.The municipality has denied mutation as they say there is some problem with the Deed where the sale agreement is between buyer (me) and the Developer (he has put his part as"*** Developer". Seems that's an issue.That should have been between me and him (his name) but not the builder company's name.FYI the owner and the builder happen to be the same person.

A.Who is the buyer here? If the deed is between the developer and the buyer then mutation can be done in the name of the buyer. And please be informed that mutation can be done only after the deed is registered.

A.U will be needed declaration of the builder for mutation entry. First builder have duty to given declaration to the 7/12 then u will be possible
