My husband and I got married in 2013.rite after marriage he and his family started fighting for dowry.passing comments after two years of marriage I started replying back and more fights started,then he started more later he suffered cancer and I was with him throughout during cure,he was completely cured 2016 Jan,then he started staying with his parents sister also came and they all started the same commenting ,bulling me,showing eyes,later my husband fought with me and told me to leave home,I left with my daughter and started staying with my family for 1 yr 6 months, now he has sent a divorce notice before divorce he deposited the dowry amount given to him by cheque at marriage in my account.his grounds for divorce are my fights with him for 7 hrs,I run away from his house,I tried to commit suicide by eating thyroxin pills .I m a thyroid pt all these charges are mere false invr ran away and NVR consumes pills .
Since your husband does not want you there is no point in living in abusive relationship.
Better you ask for better compensation ie. alimony and education of the child etc.

Thanking sir for your advice .his dad is lawyer and they r continuously pressurising us through indirect sources for divorce .he just has two reasons that I get angry ,run away and tried consuming thyroxin pills .he has some wats app chat of mine in which he says I accepted that I took pills because he tortured me.now they r telling that if I l ask for maintaince or file 498 a they will ask for custody of my daughter who is 4 yrs 6 months old

Dear Madam,
Since the child is small there is every likelihood that you will get the custody of the child.
But, the Father of the child will have the visiting rights and visit will be in the presence of the mother.This is simple.You assert your rights.

You can immediately file DV case with following prayers.

HENCE THE APPLICANT HUMBLY PRAYS
A) to take cognizance for the offence punishable u/s 498A IPC and punish Respondent No.1 to 3 as per law and extend police protection to the deponent,
B) Pass orders u/s 19, based upon S.17, granting separate residence for herself and her three children at a monthly rent of Rs. 20,000/- and advance of Rs. 5,00,000/-.
C) Pass orders u/s 18, in totality against Respondent No.1 to 3,
D) Pass orders u/s 20(i) granting Rs.25,000/- per month as maintenance for applicant and maintenance at the rate of Rs. 5,000/- each per month to her three children.
E) Pass orders granting Rs. 5,00,000/- for setting up house hold requirements, in granted residence, to make it livable, as the applicant cannot return to the house of Respondent No.1 as he is residing in the house of respondent No. 3, which is legally prohibited,
F) Pass orders granting litigation expenses of Rs.1,00,000/- as the applicant made to wander from pillar to post for getting legal aid to attend the Hon’ble Court, whereas, the Respondent No.1 falsely filed Divorce Petition.
G) The applicant also filed interim application supported by affidavit u/s 23(1) and (2) of D.V.Act,
H) That any other order/s, this Hon’ble Court deems fit, to meet the ends of justice, be passed.

Thanku sir for your advice.i just need your guidance actually my husband has some msg he said in counseling session that I tried to consume pils .I don't HV any idea about them .can this affect child custody because they don't want to pay maintaince so they may apply for child custody as she is 5 yrs old
