We are 3 childrens to our parents, the land and house constucted by us purchased in the name of my Elder sister by my brother in law in 2002. They took my father's help. And he contributed 25 % money of the property. My father just took signature for his payment to my brother in law and sister in a white paper with revenue stamp affix. After 20 years the house value appreciated, we also requesting our sister & brother law to give back our 25% share to father as per presnt value of the house. My sister and brother law denies to this. And they ready to gives only the money paid 20 yrs ago. Please let me know how we can handle this situation.

A.Let the proposal be accepted first. Once they pay back the money which was taken by him from your deceased father for construction of house in the name your sister.

Make out a receipt of said money referring stamp paper executed for the purpose 20 years ago between your father and brother in law. Let the MR be signed by all parties in presence of two witnesses

Since your father's money rolled over in the hand of brother in law for long 20 years, you may be entitled being legal heirs to claim proportionate value on same ratio on the the date of refund of said loan as per present MV of property escalated in passage of time.

So handle the matter with care otherwise in absence of valid documents it is difficult to prove your claim.

A.Dear Sir,
If you have to either file partition suit or declaration suit and the suit will be referred to Lok Adalath where you can settle the matter otherwise continue the litigation.
