If I want to make a will of my ancestral cum self acquired property of my wife name
And my all bank account money including
Can my children challenged the will in later ???


And one more thing I have a joint property with my siblings can I include in my will that whatever I have share in that joint property will goes to my wife

A.Dear Client,

Your query made me confused by the word "ancestral cum self-acquired property". Both concepts are different and handled differently. While you can dispose of your self-acquired property any way you like you cannot transfer the property without the consent of legal heirs who got right in that property by birth.

As regards joint property, you also cannot transfer your share of any undivided property in the absence of your specified share in the said joint property and also in the absence of a deed of partition.

A.Good evening!
There would be no issue in transferring the self-acquired to your wife through a will. The ancestral property can be challenged.

Answer to your both doubts are in affirmative. But Will is considered as weak document even it is registered as it can be challenged by your children on so many ground. You may go for gift or otherwise.
