Hi sir,
I'm a landlord and I have given my house for rent, the tenants have signed the agreement and have transferred the deposit but after 3 days the tenants want to cancel the agreement.The tenants have not moved to the house but I have paid the brokerage which is half of rent.In the agreement we have specified that if the tenants wants to move out before the agreement period then they have to pay 1 months rent.So according to law should they pay 1 month rent or should they only pay the brokerage amount which is half of a months rent ?

A.Dear Sir,
Both seems to be correct. Amicable settlement may be arrived by foregoing brokerage or getting brokerage from the prospective tenant. In the meanwhile keep the advance amount with you and find out another prospective tenant. If you keep the advance amount for few months then the old prospective tenant may come to your terms.

A.Dear Client,

Is the brokerage is mentioned in the agreement? If the brokerage is not specified then as per the terms of agreement land lord is entitled for one month rent as agreed upon by the tenant even he/she did not occupy the let-out premises which caused pecuniary/financial loss to the landlord.
