My father had 1.4 acre patta land + 1 acre kumki land , total 2.4 acres. This he received from his father while property partition. My father sold this to his elder brother in exchange of 70 cents of land. His brother said he would give another 1 acre of land after sometime. Believing this father agreed for registration. Now elder brother is having 2.4 acres of land, but we have only 70 cents. Now they are saying that they are not giving that 1acre land which they said they would give. This is a cheating. Is there a way for us to get our land back or compensation?

A.Dear Client,

In absence of any Written MOU/Agreement duly witnessed behind the transfer of land by your father to his brother, chance of getting back of land on the verbal assurance of parties appears to be almost remote.
However, the case the property is ancestral property obtained by your father through a partition deed, then such a transfer of property without the consent of other legal heirs who got right over the property by birth is challengable.

A.Dear Sir,
Your father has to file a suit for partition and establish his case and get remaining land from his elder brother.

Thank you Sir for the reply.

But for the 1.4 patta land already registration was done 20 years back. In that word "kumki" also mentioned.
For us registration was done only for 70 cents. Remaining 1 acre land which he supposed to give, registration was not done.

When the scenario like this, if we file suit for partition, will we get our land back?
