I have sold a plot to a buyer 7 years ago. The land is on my father':s name. At the time of selling, my father is no more and we submitted his death certificate. In addition, my mother, myself and my sister submitted aadhaar and signed on the sale deed. Now, the buyer is calling us daily to submit legal heir/family member certificate. He is saying he needs it for bank loan (to build a house in the plot) and will proceed legally if I don't co-operate or submit certificate . Can you please advise if I have any legal liability from the buyer, as I don't have legal heir/family member certificate

A.Dear Client,

You will be liable to the purchaser if any claim is raised by any legal heir other than you all in future claiming his share in the property which is an intestate property and you transferred the same after the demise of your father without any legal heir certificate or individual records of share in the said intestate property issued by the concerned authority. Even the claim is time-barred, Court may allow the claim considering the merit in the claim that overweighs the objection on the ground of limitation.

A.Dear Sir,
You are not suppose to cooperate with the purchaser because his duty was to collect such legal heir certificate from you at that point of time only.
