I have filed a case against a doctor who took 80000 for correction of asymmetry caused by previous surgery in my lips.In prayer I have asked for 190000inr. Oppostite parties have filed their version in which they mentioned complainant is bad in joinder of parties as I didn't add the doctor who done the first surgery. Will my chance of winning be less because I skipped the previous doctor who done first surgery and made it asymmetical, as case was for deficiency in service caused from costly second surgery .Is the compensation amount demanded by me is less in case of medical negligence and can i make any change in it. Can any amendment be made in the complaint in this stage (next is evidence of complainant).
In case you opted for amendment or alteration in the original complaint if requires in the course of adjudication /hearing, and even in case of no prayer alike, you may file a petition before the Court praying for amendment in title cause of the Compliant impleading a party as OP which is essentially required for the sake of justice. The said petition is allowed on merit and hearing both the parties even at the evidence stage.
