My rights about my father's house (he passed away intestate). My rights about my father's house (he passed away intestate).

I'm a 50 yr old female. My father had received a plot of land from his father-in-law. My father later built a house on top of the plot with his pension money. Not sure whose name the property is registered to. He passed intestate in Feb, 2022. Now my two elder brothers are planning to sell the house without my knowledge. What are the rights that I have in this particular scenario?

A.Hello,
As per the information you have mentioned , being a coparcener you have also the right of partition under the said property as per hindu succesion act 2005 and you cannot be deprived of your right by anyone, if done you can always file a partition suit against the wrongdoer.

A.Dear Madam,
It is the self acquired property of your father as such you are also having 1/3rd share in the said property. You may file immediately a partition suit and get a immediate stay order restraining your brothers from selling the said property.
