Non payment of maintenance charges for more than a year
11 months ago
Can society's EC members restrict usage of lift (without lift guard), parking facility, garden and entry of maid if maintenance charges are due for more than a year. And threaten to cut electricity and water supply. They also keep conducting meetings causing daily headaches, trouble me during my work hours, even though they have already served legal notice for recovery. The society's treasurer even asked the guards to deflate my car's tires. It is turning into harassment day by day. I am leaving this property now but they are forcing to pay maintenance first, even though i am not the legal owner.
A.You are responsible to pay one year's worth of maintenance, however the slashing of car tires amounts to harassment and you take legal action against it

A.Dear Client,
Being a resident owner and member of a registered Society you are dutybound to abide by the rules and regulations of the Society in respect to every matter including payment of monthly maintenance charges and for default on your part you made liable yourself to face consequences for breach of rules of the society which is registered and governed under Cooperative Society Act. Being a legal entity, Society can take legal action against you for recovery of due maintenance. Even without obtaining the NOC from the society, you are not able to transfer the title of the property to others. So instead of going into litigation, try to resolve the matter amicably with the society.
